Terms of use for the Wifi network

Terms of use of the free internet access service via WiFi provided by KRONOTEX SPAIN SL – HOSTAL KRONOGUEST (hereinafter the Hostel or Kronoguest).

These terms of use for the WiFi access services at the Hostal Kronoguest aim to regulate its use, and establish the conditions for accessing the contents and services that are made available to you, the user, through the internet, establishing a contractual relationship between Hostal Kronoguest, located at Calle Isla de Tidore, n. 8 (09199) Burgos (hereinafter “the PROVIDER”), and you.

Please read these terms carefully. At the end of these general conditions, you may accept or reject them. If you reject them, you will be unable to connect to our system. You may print or download these terms if you wish.

1. OBJECT OF THE CONTRACT

Through these General Conditions, Hostal Kronoguest undertakes to provide an internet access service via WiFi technology, and the user undertakes to use the system correctly.

2. DURATION OF THE SERVICE PROVISION

This contract will last for the same duration as the user remains accommodated at Hostal Kronoguest.

3. USERS AND ACCEPTANCE

To access the network, you need to have a password that will be provided to you when you complete your registration in our system. It is the responsibility of the user to keep this access password confidential, and its disclosure without the consent of Hostal Kronoguest is prohibited.

By accessing the WiFi services, you become a user. This user status implies the mandatory ACCEPTANCE without any reservation of each and every one of the terms of these terms of use, as well as the specific conditions applicable, if any, to the selected content or service. Only adults can be users; the use of the system by minors is subject to the authorization of their legal representatives, who are solely responsible for the minors’ use of the system.

We inform you that browsing our system is not filtered, so access to content or services unsuitable for minors is possible.

Hostal Kronoguest informs you that most devices allow blocking and filtering access to certain services and content that they do not consider appropriate. Consult the manual of the device you use.

4. CHARACTERISTICS OF THE OFFERED WIFI SERVICE

This service only allows you to access the Internet. Hostal Kronoguest cannot guarantee continuous access to this service, as interruptions in the service may occur due to technical problems, natural phenomena, damage caused by third parties, or internal maintenance. If you have any problems, please contact reception.

Hostal Kronoguest is not responsible for the information contained in the documents, graphics, audios, videos exchanged over our network, nor for those published on the sites visited or consulted by users.

We inform you that the speed of browsing may be affected by the number of users connected to our network at any given time, or by the traffic generated at that moment. The service is free of charge.

5. PROHIBITIONS AND CANCELLATION OF THE SERVICE

It is strictly prohibited to use the network for:

  • Attempting to increase a user’s system privileges.
  • Sending mass “spam” emails.
  • Violating intellectual property, industrial, or other legal rights.
  • Reselling the service or using it for commercial purposes.
  • Actions contrary to the law or morality, such as the introduction, consultation, exchange, or download of obscene, illegal, immoral, or offensive content.
  • Attacking the hostel’s system or third-party systems.
  • Intentionally obstructing other users’ access to the network by massive consumption of computer and telematics resources, as well as performing actions that harm, interrupt, or generate errors in the systems.
  • Attempting to decipher passwords, systems, or encryption algorithms, and any other security element involved in the telematic processes of the residence.
  • Any other acts of a similar nature or that can be classified as antisocial, as well as those that directly hinder the provision of the service.

Hostal Kronoguest reserves the right to cancel the service for users who violate these general conditions and, in particular, the above prohibitions.

If Hostal Kronoguest detects any illicit use of the network, it will report it to the relevant authorities in compliance with current legislation.

6. USER OBLIGATIONS

As a user, you will use the WiFi access service diligently and correctly, and undertake not to use it for activities contrary to the law, morality, accepted good customs, and/or for illegal, prohibited, or harmful purposes or effects on the rights and interests of third parties. You also agree not to use it in any way that may harm, disable, overload, damage, or prevent the normal use of the service, documents, files, and all kinds of content stored on any computer accessible via the internet. The user will be solely responsible for the consequences of violating these obligations.

7. EXCLUSION OF WARRANTIES

Hostal Kronoguest has a security document that complies with Regulation (EU) 2016/679 General Data Protection Regulation (GDPR) and Organic Law 3/2018 of December 5, on Data Protection and Guarantee of Digital Rights (LOPDGDD) and has implemented all technical means at its disposal to prevent loss, misuse, alteration, unauthorized access, and theft of data, notwithstanding that security measures on the Internet are not impregnable. The user is solely responsible for having appropriate security systems or programs on their devices, such as firewalls, antivirus software, or others that ensure security in accessing their information.

Given the many external factors beyond its responsibility and control in providing such a service, Hostal Kronoguest does not guarantee, either implicitly or explicitly, that the user can access all internet services.

8. LIABILITY

As a user, you are aware and voluntarily accept that the use of WiFi access spaces is always your responsibility.

Hostal Kronoguest is not liable for damages that may arise from telecommunication interferences or failures, disconnections in the electronic system, presence of computer viruses, malicious programs, or any other factor beyond its control.

By way of example, the user releases Hostal Kronoguest from any liability for:

  • The lack of availability and continuity of operation of the WiFi access service at Hostal Kronoguest.
  • The interruption, suspension, or cancellation of access.
  • The information transmitted by users through the channel provided by this access service.
  • Damages of any kind that may result from the misuse of this service.
  • Unauthorized access by users to protected Internet sites using hacking, cracking, etc.
  • Lack of service, slowness, etc., due to force majeure or causes not attributable to negligent actions by Hostal Kronoguest.
  • Damages of any kind that may result from third parties’ knowledge of the internet use by the user, or that may result from access and, where applicable, interception, deletion, alteration, modification, or manipulation in any way of the contents and communications of all kinds that users transmit, disseminate, store, make available, receive, obtain, or access through the service.

As a user, you are aware and voluntarily accept that the third-party service and content provider, independent of Hostal Kronoguest, which is accessed from WiFi spaces, is solely and exclusively responsible for any damages that may result from providing its content and services.

Hostal Kronoguest does not guarantee the technical availability, quality, accuracy, or truthfulness of the content and services available from third parties that you, as a user, can access from Hostal Kronoguest‘s WiFi spaces.

9. DATA PROTECTION

For security reasons, it is necessary for anyone accessing our network to be identified and authenticated. Therefore, you have been provided with a username and a personal password that remains valid for as many days as you stay at the hostel. If you need this period extended or if you encounter any problems, please contact the hostel management.

In compliance with article 11 of the LOPDGDD and article 13 of the GDPR, we inform you that:

THE DATA CONTROLLER is Kronotex Spain, SL, located at Barrio Castañares, s/n (09199) Burgos.

THE PURPOSE OF THE PROCESSING is to provide the services you request from us.

RIGHTS: You can exercise your rights of access, rectification, deletion, opposition, limitation of processing, data portability, and revocation. To exercise these rights, you can submit a written request to the data controller’s address.

10. APPLICABLE LAW AND JURISDICTION

These Terms of Use are governed by current Spanish law.

Any disputes will be subject to the Courts and Tribunals of Burgos.
